What should investors look for in an EB-5 project, and what do Regional Centers need to do in order to gain investor trust?

In 2023, USCIS released updated guidelines for how certain provisions of the EB-5 Reform and Integrity Act of 2022 (RIA) will be interpreted. One component of this guidance dealt with the EB-5 investment sustainment period, stating that the investments are expected to remain invested for at least two years.

This has caused some investors to seek out projects that promise to return their capital in as little as two years. However, this comes with some risk, opening up the potential for loss of capital or the requisite jobs not being created. That’s why it’s important for them to understand what to look for during project evaluation.
