The past year has seen a number of changes in EB-5 that resulted in lawsuits filed by Regional Centers and industry organizations. The 2023 guidance on the sustainment period involved changes made to the USCIS website without prior notice or a public comment period, and filing fees were greatly increased without a fee study being completed.

The concern for industry stakeholders is not only how the outcomes of these lawsuits might affect Regional Center and investor status, but also how they might affect efforts for reauthorization of the Regional Center Program. That’s why JTC is bringing together a group of industry experts to discuss these lawsuits, their current status, and how they could affect public and lawmaker perception of the program.
