EB-5 Investors

Under the EB-5 immigrant investor program, foreign nationals invest capital in US commercial enterprises that create local jobs. If all requirements are met, the foreign investors (and their eligible family members) may attain permanent resident status in the United States.

Normally, investors deploy their capital through experienced EB-5 “issuers” and projects, which pool EB-5 investor capital into large-scale real estate developments and other businesses.

Immigration through the EB-5 visa program is subject to strict regulation, and all investments must comply with U.S. Citizenship and Immigration Services (USCIS) and Securities and Exchange Commission (SEC) rules. These tracking and reporting requirements can place heavy administrative demands on EB-5 issuers.

USCIS also stipulates that investor funds must be held “at risk” in a commercial enterprise. It is therefore crucial that investors trust the issuer that will deploy their capital. For a successful immigration outcome, investor funds must be appropriately held and allocated over the multi-year period that the EB-5 lifecycle normally requires.
